App Terms - My Distribution

My Distribution App (“the App“) is provided by FORBRUGER-KONTAKT A/S, CVR no. 26899737, Bredebjergvej 6, 2630 Taastrup (“FK,” “We,” or “we“).

The following terms (“Terms“) apply to the use of the App. These Terms do not affect your employment contract or any other agreement with FK, which will always take precedence over these Terms.

1. MY DISTRIBUTION APP

1.1 By downloading and installing the App, you can use your smartphone to support and optimize the management of your job tasks, including the distribution of printed materials.

1.2 The App can be downloaded from the App Store if your mobile phone uses the iOS operating system or from Google Play if your mobile phone uses the Android operating system. To download and install the App on your phone, your operating system must be updated to a version compatible with the App, and you must accept the terms and conditions required by these services.

1.3 The App may be geo-blocked or IP-blocked, meaning it may not be accessible if you are in certain countries or using specific IP addresses.

1.4 The App is developed to support and optimize your tasks as a distributor for FK (“Distributor”).

1.5 The App is a work tool that provides access to necessary tools and information, including work and salary details, updating the status of tasks, communication with your distribution manager, and assistance with completing your tasks.

1.6 You can only log in and use the App if you are a Distributor or an FK employee with a work-related need to access the App.

1.7 These Terms must be accepted before you can use the App.

1.8 Functions necessary for completing your tasks can also be accessed through other digital channels, including web platforms, meaning it is not a requirement for your employment that you use the App.

 

2. USE OF THE APP

2.1 You must use your employee number or phone number in combination with your self-chosen password and two-factor authentication to log into the App.

2.2 You must not share your password with others. If you suspect your password has been compromised, you must immediately notify FK and change your password.

2.3 The App must only be used in accordance with applicable law and responsibly in accordance with generally accepted behavior.

2.4 The App may only be used to fulfill your duties as a Distributor.

 

3. LIABILITY

3.1 FK disclaims all liability for the use of the App, including any downtime and functionality issues.

3.2 FK disclaims all liability for any damage or loss, whether direct or indirect, caused by unauthorized third-party access to the App, including damages and losses resulting from data theft and unauthorized disclosure of data.

 

4. RIGHTS

4.1 FK and/or its partners own all rights to the App, including software, data, graphics, designs, business identifiers, and trademarks.

4.2 You may not copy, distribute, modify, reverse-engineer, or otherwise manipulate the App.

 

5. USER CONDUCT

5.1 Any automated, systematic, and/or analytical use, download, reuse, extraction, scraping, or similar collection or copying of data and material from the App is prohibited.

5.2 FK may exclude users from or restrict the use of the App if they violate these Terms. FK also reserves the right to take legal action against users who breach these Terms.

 

6. CHANGES TO TERMS AND THE APP

6.1 FK may modify these Terms and the App at any time without notice. The most up-to-date Terms can be found in the App. You will be notified of significant changes to these Terms before they take effect.

6.2 FK is entitled to transfer its rights and obligations under these Terms to any company within the North Media A/S group at any time.

6.3 FK is required to comply with applicable laws and reserves the right, without notice, to delete, modify, or restrict content or functions in the App that do not comply with these Terms, applicable laws, or requirements from public authorities.

 

7. PROCESSING OF PERSONAL DATA

7.1 We protect your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (“GDPR“) and the Danish supplementary law to GDPR, the Data Protection Act.

7.2 Personal data is collected and processed in connection with your use of the App. The collection and processing of your personal data are necessary to provide the App with its required functionality. You can read more about FK’s processing of your personal data and your rights in the latest version of the applicable privacy policy here.

7.3 In connection with your use of the App, personal data may also be collected and processed through cookies or similar technologies. This data collection and processing is solely for statistical and analytical purposes to assess how we can continuously improve the App. This collection and processing of your personal data will only occur if you have given your explicit consent. 7.4 You can always contact FK at GDPR@northmedia.dk if you have questions regarding the collection and processing of your personal data.

 

8. TERMINATION OF USE

8.1 FK reserves the right to exclude or restrict the use of the App, as stated in Section 5.2, if you violate any provisions of these Terms or if your use is deemed a security risk.

8.2 If your access to the App is suspended or terminated, FK will inform you of the reason unless such notification is deemed inappropriate.

8.3 You may request to have your access to the App closed at any time by contacting app.support@fk.dk via email.

 

9. SECURITY

9.1 When you use the App, information about your usage is logged. You can read more about FK’s processing of your personal data in connection with security measures in the most recent version of the applicable privacy policy here.

9.2 Logging is conducted to troubleshoot and correct any crashes or similar technical issues, as well as to maintain an appropriate level of security.

 

10. GOVERNING LAW AND DISPUTES

10.1 These Terms are governed by Danish law.

10.2 Any dispute arising from the use of the App or these Terms shall be settled by the Danish courts.
